Manuscripts and notes by Michel Foucault on the visual arts recently deposited at the Bibliothèque Nationale reveal a reliance on canonical oil paintings by the ‘old masters’; a respect for the primary sources in the history of European art; an understanding of the necessity of research in both literary and visual sources, particularly self-portraits; and a sense of the value that a certain philosophical milieu – beginning with Sade and Nietzsche and expanding to his near contemporaries, Bataille, Blanchot, and Klossowski (...) – could offer to an understanding of paintings. The essay argues that Pierre Klossowski’s monumental drawing La Nef des fous (1990) provides an essential key for understanding the place of Hieronymus Bosch’s painting of the same title in History of Madness and the centrality of theories of similitude to Foucault’s thinking about visuality ca. 1960–74. The later significance of the figure of the artist for Foucault can be traced to these earlier writings on painting and madness. (shrink)

This essay addresses mineral water as a medical, experimental and economic material. It focuses on the career of the Reverend Dr William Laing , a physician and cleric who wrote two pamphlets about the water of provincial spa located in Peterhead, a town on the north-east coast of Scotland. I begin by outlining his education and I then reconstruct the medical theory that guided his efforts to identify tonics in the well’s water. Next, I explain why Laing and (...) several other local inhabitants thought themselves to be authorities on the palliative power of the water and I close by showing how such effects were commodified by local entrepreneurs. Although I concentrate primarily upon Peterhead Spa, this study touches upon several issues relevant to the types of medical theory and chemical experimentation that were being used in provincial Scotland during the late eighteenth and early nineteenth centuries. Talents often play a significant role in our personal and social lives. For example, our talents may shape the choices we make and the goods that we value, making them central to the creation of a meaningful life. Differences in the level of talents also affect how social institutions are structured, and how social goods and resources are distributed. Despite their normative importance, it is surprising that talents have not yet received substantial philosophical analysis in their own right. As a (...) result, the current literature is rife with conceptual ambiguity: a talent is referred to as all of a skill, potential, ability, capacity, endowment, and a natural gift. In response to this confusion, in this paper I develop an account of what a talent is, based on the debate concerning the metaphysics of ability and dispositions. I argue for a position that I call ‘talent dispositionalism’: S has a talent for skill A in circumstances C iff S has the general disposition to excellently develop and maintain A when, in circumstances C, she tries to excellently develop and maintain A. On this account, a talent is not the skill itself, but a general iterated ability for the excellent development and up-keep of a particular skill, constituted by an agent’s dispositional properties. I defend the account against four objections usually levelled against traditional dispositionalist theories of ability, and highlight some ways the account may influence debates in other areas of philosophical inquiry. In the last decade, the organization of pharmaceutical research on neglected tropical diseases has undergone transformative change. In a context of perceived “market failure,” the development of new medicines is increasingly handled by public-private partnerships. This shift toward hybrid organizational models depends on a particular form of exchange: the sharing of proprietary assets in general and of intellectual property rights in particular. This article explores the paradoxical role of private property in this new configuration of global health research and development. (...) Rather than a tool to block potential competitors, proprietary assets function as a lever to attract others into risky collaborative ventures; instead of demarcating public and private domains, the sharing of property rights is used to increase the porosity of that boundary. This reimagination of the value of property is connected to the peculiar timescape of global health drug development, a promissory orientation to the future that takes its clearest form in the centrality of “virtual” business models and the proliferation of strategies of deferral. Drawing on the anthropological literature on inalienable possessions, we reconsider property’s traditional exclusionary role and discuss the possibility that the new pharmaceutical “commons” proclaimed by contemporary global health partnerships might be the precursor of future enclosures. The 'no-supervenience' theorem (Reason, 2019; Reason and Shah, 2021) is a proof that no fully self-aware system can entirely supervene on any objectively observable system. I here present a simple, non-technical summary of the proof and demonstrate its implications for four separate theories of consciousness: the 'property dualism' theory of David Chalmers; the 'reflexive monism' of Max Velmans; Galen Strawson's 'realistic monism'; and the 'illusionism' of Keith Frankish. It is shown that all are ruled out in their current form by (...) the no-supervenience theorem, except for Chalmers' theory, which I show requires humans to behave irrationally. (shrink)

Hume'sDialogues Concerning Natural Religion are still much with us. What appears to be the definitive edition was published by Professor Norman Kemp Smith in 1935 with a learned introduction which, among other things, assembled a mass of evidence pointing to the conclusion that Philo is to be identified with Hume himself, and that Hume in the Dialogues is deliberately trying to undermine the religious hypothesis. Though these conclusions have been widely accepted, Dr. B. M. Laing, in the April issue (...) of Philosophy, strenuously attacked them in an ingenious argument based in part on his already published thesis that Hume's fundamental philosophy is not really the scepticism so long assigned him. Dr. Laing takes the opportunity in passing to indicate his sympathy with the recent position of a distinguished British poet that Voltaire, also, has been traditionally abused in the assumption that on the question of religion he wrote with his tongue in his cheek. The present examination is not designed to inquire into this new mode of making the wicked pious; nor to push the question back from the Dialogues to Hume's basic philosophy; nor to press the writer's conviction [“The Enigma of Hume,” Mind, XLV pp. 334–349] that not only is Philo to be identified as Hume, but in addition, Cleanthes as Joseph Butler, and Demea as Samuel Clarke. The present purpose is solely to indicate certain unhistorical bases of Dr. Laing's attack on the more traditional view so ably championed by Professor Norman Kemp Smith. (shrink)

Activists’ investigations of animal cruelty expose the public to suffering that they may otherwise be unaware of, via an increasingly broad-ranging media. This may result in ethical dilemmas and a wide range of emotions and reactions. Our hypothesis was that media broadcasts of cruelty to cattle in Indonesian abattoirs would result in an emotional response by the public that would drive their actions towards live animal export. A survey of the public in Australia was undertaken to investigate their reactions and (...) responses to. The most common immediate reaction was feeling pity for the cattle. Women were more likely than men to feel sad or angry. Most people discussed the media coverage with others afterwards but fewer than 10 % contacted politicians or wrote to newspapers. We conclude that the public were emotionally affected by the media coverage of cruelty to cattle but that this did not translate into significant behavioral change. We recommend that future broadcasts of animal cruelty should advise the public of contact details for counseling and that mental health support contacts, and information should be included on the websites of animal advocacy groups to acknowledge the disturbing effect animal cruelty exposes can have on the public. Abstract:While many aspects of stock and option based compensation for corporate officers remain controversial, we suggest that the growing trend for similar practices in favor of boards of directors will prove to be even more contentious. High-ranking corporate managers do not set their own salaries nor authorize their own stock options. By contrast, boards of directors do, in fact, set their own compensation packages. Other potential conflicts of interest include setting option performance targets, stock buybacks, stock option resets and reloads, (...) consolidations (mergers and acquisitions), and service on multiple boards. As trust is the most valuable commodity in a capitalist society, we suggest that these potential conflicts of interest and related outcomes may ultimately serve to erode any anticipated benefits of director stock compensation. The philosophical faculty of the Jesuit Berchmanskolleg in Pullach has long since made its mark in the publishing world, and the new series of philosophical studies from Father Lotz and his associates, of which these two volumes are an auspicious beginning, shows every sign of living up to the high standard we have come to expect. Volume I is a collection of five essays: a comparison between the Thomistic and Kantian theory of knowledge, by Fr. de Vries; the transcendental method (...) in Kant and in Scholasticism, by Fr. Lotz; the Absolute in the Kritik der reinen Vernunft, by Fr. Brugger; formalism in Kant’s ethics, by Dr. Schmucker; and the relationship between Kant and Heidegger, by Fr. Coreth. It concludes with a particularly useful bibliography of scholastic literature on Kant between 1920 and 1955, compiled by Fr. Brugger. After Jansen, Maréchal is the scholastic writer with most published studies on Kant to his credit, and it is not surprising that his influence should make itself felt in the present volume. His monumental Le point de départ de la métaphysique marked a definite turning–point in the scholastic attitude towards Kant, and one has only to read this collection of studies to realise how the atmosphere has changed in the course of the last fifty years. Fr. de Vries devotes almost two–thirds of his essay to what St. Thomas and Kant hold in common with regard to the discursive nature of human understanding, the structure of the sense–image and its relation to the intellectual concept, though he also brings out the fundamental difference between the two on the questions of self–consciousness, natural theology and the reality of the external world. Not only does he show a healthy respect for the many grains of truth in the philosophy of Kant, but he insists that Thomists have much to learn from the German philosopher on the question of strict, critical method. Scholastics of the traditional school were satisfied with what Fr. Lotz describes as the “objective method” and rejected the “subjective” as smacking of subjectivism or idealism. In the longest essay of the five, Fr. Lotz compares the Kantian and Scholastic methods. Kant himself described his Kritik der reinen Vernunft as a “treatise on method rather than a scientific system”, and in the course of the book he condemns the objective approach as dogmatic and uncritical, leaving only the subjective method, which rules out any possibility of metaphysics. Fr. Lotz rightly asserts that even the most modern scholastic cannot dispense with the objective method, but he maintains that it demands to be completed by the subjective. Many scholastics will agree with him on the usefulness of the latter, and indeed an amount of research has been done in this field in recent decades. But how many will agree when he says that scholastic objectivism includes the subjective or transcendental method as the only way, or the only basis on which objectivism can stand? Maréchal’s influence is evident in his treatment of the faculties of the soul. But, however one may quibble at individual points in the book, it nevertheless remains a very valuable contribution to the scholastic literature on Kant. (shrink)

In this paper, I propose that Derrida’s writing on the impossibility of justice has the potential for fruitful dialogue with Ruth Chang’s contemporary account of practical rationality. For Derrida, making a just decision must always come with a moment of undecidability, a “leap” into the unknown with an experience of doubt and anxiety that continues to “haunt” the decision-maker. By contrast, in her work on rationality, Chang proposes that hard decisions are difficult to make because the alternatives are “on a (...) par,” such that there are no rational differences between the alternatives that would contribute to choosing one over the other. Hard decisions are made by expressing one’s own rational agency, generating will-based reasons to commit to or “drift” into one of the alternatives. Derrida writes of anxiety, doubt, and impossibility, yet Chang writes of commitment, agency, and rationality. Despite these differences, there are important comparisons and connections between the two accounts that are worth exploring. I suggest that the moment of the decision which Derrida describes as heterogeneous to knowledge can be understood as a moment of parity in which there is a lack of given reasons, as explained by Chang. Chang’s account of rational agency provides an interpretation of how decision-making is possible despite the undecidability as described by Derrida. This notion of commitment and agency as explained by Chang is not incompatible with Derrida’s insistence that the responsible decision is haunted by anxiety and doubt. Instead, I suggest that Derrida’s writing highlights uncertainty as central to understanding the nature of hard choices and how to navigate the demands of justice. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:HUME ON THE 'DISTINCTION OF REASON1* In a 1959 paper, Richard H. Popkin1 propounded what was then taken to be a most extraordinary thesis: Hume may never have read Berkeley. Popkin's paper marks the end of one of the stranger stories in the history of philosophy, the relationship of the British Empiricists — Locke, Berkeley, Hume — to one another. The thesis was hardly news either to Berkeley or (...) Hume scholars because for several decades in careful studies of the historical contexts and sources they had relied less and less on any theory about significant common themes. In this paper I rehearse the arguments against the "partnership" doctrine and then turn to some ways in which Berkeley and Hume differ over abstractionism and the 'distinction of reason'. Finally, I discuss George Davie's suggestion that this 'distinction' may belong to a very different side of Hume's thought. The linking of Locke with Berkeley is not a feature of early commentary on Berkeley. Berkeley was seen by his contemporaries as a product of Pierre Bayle's scepticism or of Malebranche's immaterialism.2 The work of A.A. Luce, and to a lesser extent, of T. E. Jessop, seeks to restore Berkeley to a place in those traditions and to reduce his indebtedness to Locke. The work of Hume scholars from Kemp Smith to Ardal, Davie, Norton, and Popkin all places Hume outside the direct Berkeley line. So far as the traditional epistemological picture was concerned, there was not enough internal evidence to support a Hume-Berkeley connection. The argument took a different turn when a new Hume letter came to light. Hume's letter to Michael Ramsay from Orleans is dated August 31, 1737. I desire of you, if you have Leizure, to read over La Recherche de la Vérité of Pere Malebranche, the Principles of 90 Human Knowledge by Dr Berkeley, some of the more metaphysical Articles of Bailes Dictionary; such as those /...of/ Zeno, & Spinoza. Des-Cartes Meditations wou'd also be useful....5 In 1973, Michael Morrisroe, Jr., surveyed the contributions of Wiener, Popkin, Mossner, Hall, Flew, and Conroy to the debate. Morrisroe takes the several Hume references to Berkeley as internal evidence that Hume read Berkeley. He then prints a new Hume letter to Michael Ramsay, dated "Rheims. Sepfc. 29 1734. N. S." A ten sentence letter, the eighth reads: "It is my Pleasure to read over again today Locke's Essays and the Principles of Human Knowledge by Dr. Berkeley which are printed in their original state and in French copy." Morrisroe explains in a footnote that he was granted permission to make a typescript of the letter, that it was sold at auction, and that its "present location... is unknown." In addition, he thanks six graduate students: "without their attention to bibliogaphical detail this letter might not have been made ready for publication until much later." But the bibliographical detail does not include telling us whether he saw the original or how the Hume authorship was established; nor does it include speculation on what Hume means in that eighth sentence. Did Hume find one book containing Locke and Berkeley in French and in English which he then read in one day? A bilingual Locke plus a bilingual Berkeley? Or can he mean an edition of Locke's Essay in French and an edition of Berkeley's Principles in English? That seems to be the least likely interpretation, unless the reference to Berkeley is a mere parenthetical afterthought, and Hume had his hands on Locke in English and French plus an English edition of Berkeley. Whatever this letter means, we know that Locke's Essay was available in Pierre Coste's translation. Berkeley is another story. The "Principles appeared in 1710. A revised edition, together with the Three Dialogues (also revised) was published in 1734. The first French edition appears to have been in 1889. The Three Dialogues first appeared in 1713 and the first French translation in 1750. The New Theory of Vision, first published in 1709, appeared together with the first edition of Alciphron in 1732. French translations appeared together in 1734. In any case, it can be granted, if only on... (shrink)

A commonly raised criticism against celebrity culture is that it celebrates people who become famous without any connection to their skills, talents or achievements. A culture in which people become famous simply for being famous is criticized for being shallow and inauthentic. In this paper we offer a defence of celebrity by arguing against this criticism. We begin by outlining what we call the Talent Argument: celebrity is a negative cultural phenomenon because it creates and sustains fame without any connection (...) to the accomplishments that arise from an expression of talent or skill. By appealing to the metaphysics of talent and skill, we argue against the Talent Argument and propose that being a celebrity requires the skills that are necessary to acquire and maintain one’s status as a celebrity. A celebrity is more likely to be talented and successful in their expression of these skills, and even celebrities who are ‘famous for being famous’ will often display talents and skills that give rise to their fame. This means that those who critique celebrity culture should not do so by appealing to the Talent Argument. We show how our account of celebrity, talent and skill works to reject both the strong version of the Talent Argument, as well as a weaker and more plausible version of the argument we call the Valuable Talents argument. We conclude by noting that our analysis has demonstrated the need to explore more closely the kinds of skills that are necessary to cultivate celebrity status. This allows for a more nuanced understanding of what a celebrity is, and the values that are attached to celebrity culture. (shrink)

The term "third wave" within contemporary feminism presents some initial difficulties in scholarly investigation. Located in popular-press anthologies, zines, punk music, and cyberspace, many third wave discourses constitute themselves as a break with both second wave and academic feminisms; a break problematic for both generations of feminists. The emergence of third wave feminism offers academic feminists an opportunity to rethink the context of knowledge production and the mediums through which we disseminate our work.

The conduct of research in settings affected by disasters such as hurricanes, floods and earthquakes is challenging, particularly when infrastructures and resources were already limited pre-disaster. However, since post-disaster research is essential to the improvement of the humanitarian response, it is important that adequate research ethics oversight be available. We aim to answer the following questions: 1) what do research ethics committee members who have reviewed research protocols to be conducted following disasters in low- and middle-income countries perceive as the (...) key ethical concerns associated with disaster research?, and 2) in what ways do REC members understand these concerns to be distinct from those arising in research conducted in non-crisis situations? This qualitative study was developed using interpretative description methodology; 15 interviews were conducted with REC members. Four key ethical issues were identified as presenting distinctive considerations for disaster research to be implemented in LMICs, and were described by participants as familiar research ethics issues that were amplified in these contexts. First, REC members viewed disaster research as having strong social value due to its potential for improving disaster response, but also as requiring a higher level of justification compared to other research settings. Second, they identified vulnerability as an overarching concern for disaster research ethics, and a feature that required careful and critical appraisal when assessing protocols. They noted that research participants’ vulnerabilities frequently change in the aftermath of a disaster and often in unpredictable ways. Third, they identified concerns related to promoting and maintaining safety, confidentiality and data security in insecure or austere environments. Lastly, though REC members endorsed the need and usefulness of community engagement, they noted that there are significant challenges in a disaster setting over and above those typically encountered in global health research to achieve meaningful community engagement. Disaster research presents distinctive ethical considerations that require attention to ensure that participants are protected. As RECs review disaster research protocols, they should address these concerns and consider how justification, vulnerability, security and confidentially, and community engagement are shaped by the realities of conducting research in a disaster. I argue that we have good textual reason to read Kant’s notion of “self-conceit,” and his theory of immorality more generally as being founded on the claim that we have the tendency to think that our ability to achieve happiness is our most valuable feature. I explain how this is not the same as the claim that we are arrogant or think we are better than others. Self-conceit (and the standard of assessment it implies) can lead to the opinion that (...) one is worth more than others, when life is going well. When life goes badly, however, it leads to the opinion that one is worth less. I explain how this reading of self-conceit also amounts to a better theory of immorality, since we ought not to hold that interpersonal arrogance is at the heart of all immorality. (shrink)

In this chapter we outline the need to develop ethical frameworks to guide research on the role of animal-orientated health, therapeutic, and service interventions. We discuss findings from our research on uses of animals in therapeutic settings and benefits of human–canine interactions for human health. These stories from the field reveal that current ethics review processes do not recognise the animal as an equal partner in the potential reciprocal benefits and risks of therapeutic human–animal relationships. We explore how these review (...) processes frame research on the relationships between humans and non-human animals and use the ethical review system of Aotearoa/New Zealand as an example. We propose an ethical framework that goes beyond animal welfare legislation and recognises a range of non-human animal capacities. (shrink)

Many elite athletes find the loss of their athletic abilities due to age or injury to be a profoundly challenging experience. While talent development is a well-studied phenomenon, far less attention has been paid to the issue of talent loss. We address this gap by exploring the experience and challenges faced by elite athletes who are losing, or who have lost, their talent. Drawing on three different understandings of the nature of talent, we argue that the experience of talent loss (...) is constituted by three distinct yet interrelated forms of disorientation. We conclude by examining how athletes and those supporting them may respond to these challenges. (shrink)

The principle that epistemic justification is necessarily transmitted to all the known logical consequences of a justified belief continues to attract critical attention. That attention is not misplaced. If the Transmission Principle is valid, anyone who thinks that a given belief is justified must defend the view that every known consequence of the belief is also justification of the conclusion in an obviously valid argument. Once created, the gap is hard to fill, whatever the circumstances. Reflection principle is modified, the (...) possibility of deductive justification is threatened. If some known consequence fails to be justified, the failure may extend to every known consequence. To reject Transmission is to insert a logical gap between the justification of a premise and the justification of the conclusion in an obviously valid argument. Once created, the gap is hard to fill, whatever the circumstances. Reflection on the Transmission Principle therefore usefully brings us face to face with the following dilemma: accept the principle and hand Cartesian scepticism a powerful weapon, or modify the principle and risk undermining deductive justification. In “Social Media, e‐Health, and Medical Ethics,” in this issue of the Hastings Center Report, Mélanie Terrasse, Moti Gorin, and Dominic Sisti address and suggest recommendations for several ethical issues central to the systematic ethical analysis of the effects of social media on clinical practice, health services research, and public health. The topic is as timely as it is important: social media data collected by device and web applications are constantly increasing and might have both individual and public health benefits. (...) The authors focus their analysis primarily on the health care context. Yet the implications of the intersection of social media data and research warrant focused consideration, as even the most thorough ethical analysis in the clinical context is not necessarily directly applicable in the research context. While many ethical issues are present in both settings, the research context poses new challenges and calls for consideration of distinct factors. In particular, because the legal framework is less protective in research, critical ethical analysis of the research‐specific issues and considerations is essential to the ethical conduct of research using social media data as well as to the design and operation of social media device and web applications themselves. At the core of the tort preemption cases before the U.S. Supreme Court is the extent to which state law can impose more stringent liability standards than federal law. The express preemption cases focus on whether the state law requirements are “different from, or in addition to” the federally imposed requirements. And the implied conflict preemption cases examine whether the state law standards are incompatible or at least at odds with the federal regulatory scheme. But the preemption cases in the (...) appellate pipeline - what I shall term the “second wave” of preemption cases - address a separate analytic question. Their focus is less on the substantive aspects of regulatory standards, and more on their enforcement. When can state tort law impose substantive duties or obligations that are “parallel” to federal requirements without thereby encroaching upon a federal agency’s discretionary enforcement prerogative? This is the new frontier in products liability preemption. My proposed model suggests that courts facing these new issues should solicit input from federal agencies before resolving them. The model thereby offers a hybrid private-public model for the regulation of health and safety. It advocates an extension of my “agency reference model” to the “enforcement preemption” context: courts should place more emphasis on FDA input when deciding whether tort requirements are “parallel” to federal dictates, and whether, even if they are, they nonetheless infringe on the federal agency’s discretionary enforcement prerogatives. Courts would thus seek guidance from federal agencies to determine whether a private right of action exists for the enforcement, via state law claims, of federal regulations. (shrink)
